Federation of Jewish Communities of Spain welcomes Supreme Court ruling on hate crimes

The Federación de Comunidades Judías de España (FCJE) has welcomed the judgment by the Criminal Chamber of the Tribunal Supremo, describing it as highly significant in the fight against antisemitism in Spain.

According to the FCJE, the ruling strongly upholds the defence of human dignity and calls for a broad and firm application of Article 510 of the Spanish Criminal Code in cases involving various forms of intolerance, including antisemitism and discrimination based on national origin. The judgment places particular emphasis on the exclusion and discrimination suffered by victims.

The Supreme Court affirms the principles of dignity, equal treatment and non-discrimination, making clear that these protections extend to acts motivated by antisemitism, racism and other manifestations of intolerance.

The ruling further confirms that offences covered under Article 510 constitute public crimes, prosecutable ex officio without the need for a formal complaint by the victim. This enables the public prosecutor’s office to act independently.

The FCJE expressed confidence that the Supreme Court’s case law will be applied to strengthen the protection of victims, without requiring them to lodge a prior complaint.
